1. Jurisdiction

All deliveries and services of kidsroom.de are made exclusively on the basis of the following Terms and Conditions (T&C) and in the version valid at the time of the order. Provisions deviating from these terms and conditions shall only apply if they have been expressly confirmed by kidsroom.de in written form.

2. Offer and conclusion of contract

Offers by kidsroom.de are always non-binding with regard to the details of price, quantity, delivery times and delivery options. In particular, in the case of obvious typing and calculation errors on the website or in the context of correspondence, the customer shall not be entitled to any claims against kidsroom.de. Colour deviations between product images and goods may be possible due to the graphic materials used.

By "submitting" the basket (click on the button "Complete order") the customer makes a binding offer for the order of the goods in the shopping basket. The confirmation of the receipt of order by kidsroom.de takes place immediately after "submitting" the order by e-mail. The acceptance of the offer via kidsroom.de takes place by the delivery confirmation sent by e-mail or by the delivery of the goods. By sending this e-mail, the purchase contract between the customer and kidsroom.de is legally binding.

kidsroom.de points out that all products are sold only in normal household quantities and only for private use; this applies irrespective of whether it concerns one or more ordering processes that relate to the same product.

3. Retention of title

Until full payment, the goods remain the property of kidsroom.de. The customer who transfers the goods to third parties is obliged to inform the third party of this reservation of title.

4. Prices, payment methods, delay

The total price of the order including shipping costs will be shown in the shopping cart in Euro (€). All prices include the current statutory VAT rate. For deliveries to countries outside the EU, delivery is free of VAT. VAT may be payable on receipt of the delivery in accordance with the statutory provisions in the amount of the applicable VAT rate in the recipient country. Related loads or costs are not covered by kidsroom.de. The net prices are shown in the shopping basket when selecting the country of dispatch. Payment can be made by cash in advance, cash on delivery, credit card, PayPal or financing. The due date of the total amount depends on the order confirmation. For orders by credit card, PayPal or financing the payment process is triggered upon completion of the order.
If the customer is in default of payment, kidsroom.de is entitled to charge default interest of 5 percentage points above the base rate p.a. If kidsroom.de can prove a higher damage caused by default, the customer is obliged to compensate for this damage.
kidsroom.de reserves the right to refuse payment methods and / or deliveries due to outstanding arrears.

Payment via invoice and financing
In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you invoice and payment in instalments as payment options. Please be aware that Invoice and Part Payment are only available for consumers and that the payment is to be made to Klarna. The use of these payment methods further requires a positive credit assessment.

Invoice

Part Payment
With the financing service from Klarna you can pay your purchase in flexible monthly instalments of at least 1/24 of the total amount (at least 6.95 €) or else according to the conditions stated in the checkout. The instalment payment is due at the end of each month after submission of a separate monthly invoice by Klarna. Data Protection Notice
Klarna reviews and evaluates the data you provided and in case of legitimate interest performs a data exchange with other companies and credit rating agencies. Your personal data will be processed in accordance with applicable data protection law as described in Klarnas privacy statement.

5. Offset, retention

The offset right is only available to the customer if his counterclaims are legally established or recognised by kidsroom.de. A right of retention of the customer can only be exercised with full legal effect if it results from the same contractual relationship.

6. Terms of delivery

Place of performance is in any case the headquarters of kidsroom.de, currently: Am Langen Streif 11, 36433 Bad Salzungen / OT Langenfeld, Germany.
For shipping within Germany, a fee of € 4.99 will be charged. From a purchase value of € 100.00, the shipping within Germany is free of charge. The shipping of "bulky" items will be charged with a surcharge of € 20,00. The shipping costs within Germany include VAT at the current rate of 19%. Shipping costs abroad are calculated in the shopping basket - the amount depends on the weight of the goods and on the number of packages.

As far as no deviating, explicit agreement with kidsroom.de was made, the goods ordered are exclusively delivered to the address specified by the customer. The delivery address may differ from the billing address.

The delivery takes place while stocks last. If kidsroom.de finds out that the ordered items are no longer available while processing the order, a separate notification of the customer via e-mail as well as an immediate refund of payments already made takes place.

If ordered products cannot be delivered due to breaches of contract by suppliers of kidsroom.de but without actual fault of kidsroom.de, kidsroom.de is entitled to withdraw from the customer. In this case, the customer will be informed separately by e-mail about the non-availability of the products, and an immediate refund of payments already made by the customer to kidsroom.de takes place. The legal rights of the customer remain unaffected.

If a delivery of the ordered products is not possible because the goods are not deliverable due to the condition of doors, staircases or other facilities of the customer, the customer bears the costs for the unsuccessful delivery attempt. The same applies in the event that the customer is not found at the delivery address at the time of delivery despite prior notification of delivery. Kidsroom.de expressly reserves the right to assert further damages caused by delay.

7. Delivery times / partial delivery

The delivery times stated in the online shop or confirmed by kidsroom.de are met as far as possible. kidsroom.de is entitled to partial deliveries.

8. Passing of risk

If the customer is a consumer within the meaning of § 13 BGB (Civil Code of Germany), the risk of accidental loss and / or accidental deterioration of the goods passes to the customer upon handing over of the goods to him.

If the customer is an entrepreneur within the meaning of § 14 BGB (Civil Code of Germany), the risk of accidental loss and / or accidental deterioration of the goods passes to a suitable transport person upon handing over of the goods to this person.

If the customer is in default of acceptance, the material risk passes to him at this time.

9. Right of Cancellation

Instruction of revocation:
You have the right to cancel this contract within fourteen days without stating the reasons for your cancellation. The withdrawal period is fourteen days from the day on which you or a third party nominated by you, other than the carrier, has or have taken possession of the last goods. In order to use you right of cancellation, you must inform us (kidsroom.de GmbH & Co. You can use the attached sample cancellation form for this but this is not mandatory. You can also fill in and submit the sample cancellation form or another clear statement to our email address (widerruf@kidsroom.de). If you make use of this option, we will immediately send you (e.g. by email) a confirmation of the receipt of such a revocation.

In order to comply with the revocation period, it is sufficient for you to send the notification to exercise your right of revocation before the revocation period expires.

Legal Consequences of Revocation:
In the event that you decide to cancel this agreement, we are obliged to return any payments we have received from you, including delivery charges (except for additional costs arising from choosing a delivery method other than the cheapest, standard delivery offered by us) without delay and at the latest within fourteen days from the date on which the notice of cancellation for this contract is received. The refund will be processed using the same payment method used in the original transaction unless expressly agreed otherwise; in no instance will fees be charged for this refund. We may refuse to refund payments until we have received the goods again or until you have demonstrated that you have returned the goods, whichever is sooner.
You must return or hand over the goods promptly and in any case no later than fourteen days from the date on which you have informed us about the cancellation of this agreement. The deadline is guaranteed if you send the goods before expiry of the fourteen-day period. You must bear the direct costs of returning the goods.

You will only be liable for any possible loss in value of the goods, if this loss in value is attributable to any handling that is not necessary for the testing of the quality, properties and function of the goods.

Agreement:
The customer agrees with kidsroom.de and acknowledges in this respect, on bearing the regular cost of returning the goods, if the goods sent are those which were ordered.
